Returns and Complaints Policy
1. Right of Withdrawal from the Contract
In accordance with applicable law, you have the right to withdraw from a distance contract, i.e. to return purchased products, without giving any reason, within 14 days from the date of delivery of the order. To exercise the right of withdrawal, you must inform us of your decision by submitting an unequivocal statement electronically to the following address: sklepbookomania@gmail.com or in writing to the registered office address of the store: Wężerów 102B, 32-090, Słomniki, using the withdrawal form available on the store’s website. To meet the deadline, it is sufficient to send the written statement before its expiry.
1.1. The period for withdrawal from the Sales Contract shall begin, for a Sales Contract under which the entrepreneur delivers the Product – from the moment the Consumer or a third party indicated by the Consumer, other than the carrier, takes possession of the Product, and in the case where the Sales Contract covers multiple Products which are delivered separately, in batches or in parts – from the moment of taking possession of the last Product, batch or part; for other contracts – from the date of their conclusion.
1.2. In the event of withdrawal from the Sales Contract, it shall be deemed not to have been concluded.
1.3. If the Consumer submitted a statement of withdrawal from the Sales Contract before the Seller accepted their offer, the offer shall cease to be binding.
1.4. The Seller is obliged to immediately, no later than within 14 days from the date of receipt of the Consumer’s statement of withdrawal from the Sales Contract, refund all payments made by the Consumer, including the cost of Delivery of the Product to the Consumer. The Seller may withhold reimbursement of payments made by the Consumer until the Product is returned or the Consumer provides proof of having sent back the Product, depending on which event occurs first.
1.5. The Consumer is obliged to return the Product to the Seller immediately, however no later than within 14 days from the date on which they withdrew from the Sales Contract. To meet the deadline, it is sufficient to send the Product to the Seller’s address before the expiry of this period.
2. Rules for the Return of Goods
2.1. Only products that are in an intact condition, unused and in their original packaging are eligible for return.
2.2. Books that are damaged or show visible signs of use are not eligible for return.
3. Return Procedure
3.1. To make a return, please send the products to the address Wężerów 102B, 32-090, Słomniki, together with a completed return form (found under STORE REGULATIONS) to the e-mail address: sklepbookomania@gmail.com.
3.2. The costs of shipping related to returning the product shall be borne by the buyer, unless the return results from receiving a defective product.
3.3. Responsibility for proper securing of the returned goods rests with the buyer. The product should be carefully packed so that it is not damaged during transport.
4. Refund of Payments
4.1. The Seller shall refund the payment using the same method of payment as used by the Consumer, unless the Consumer has expressly agreed to a different method of refund that does not involve any costs for them.
4.2. After receiving and checking the returned goods, the refund will be made within 14 business days.
4.3. In the event of withdrawal from the contract, we refund the full amount of the order, excluding the costs of return shipping, which are borne by the customer.
4.4. In the case of returning products damaged due to the customer’s fault or incomplete products, or products damaged in transport due to improper securing of the products by the customer, we reserve the right to reduce the refunded amount or refuse the refund.
5. Complaints and Exchange of Goods
5.1. Complaint about the Product(s)
a) It is recommended to check the contents of the shipment in the presence of the courier / carrier employee at the time of delivery and to prepare a complaint report. Checking the contents of the shipment in the presence of the courier / carrier employee is free of charge and is part of their duties.
b) If the delivered shipment is clearly damaged (visible traces of flooding, significant dents, tears in the packaging, etc.), it is recommended to refuse acceptance. In such a case, the shipment will be immediately returned to the Seller in order to clarify the matter and redeliver the ordered Product / ordered Products.
c) The legal basis and scope of the Seller’s liability towards the Customer, if the sold Product has a physical or legal defect (warranty), are specified in the provisions of the Civil Code Act, in particular in Article 556 and subsequent articles of the Civil Code.
d) A complaint may be submitted by the Customer in writing to the e-mail address sklepbookomania@gmail.com or to Wężerów 102B, 32-090, Słomniki after completing the complaint form available under STORE REGULATIONS.
If the complaint concerns a Product, it is usually advisable to deliver it to the Seller together with the complaint in order to enable the Seller to examine the Product.
e) In the event that the sold Product has a defect, the Customer may:
- submit a statement requesting a price reduction or withdrawal from the Sales Contract, unless the Seller immediately and without excessive inconvenience to the Customer replaces the defective Product with one free from defects or removes the defect. The reduced price should remain in such proportion to the contract price as the value of the Product with the defect remains to the value of the Product without the defect. The Customer may not withdraw from the contract if the defect of the Product is insignificant;
- request replacement of the Product with one free from defects or removal of the defect. The Seller is obliged to replace the defective Product with one free from defects or remove the defect within a reasonable time without excessive inconvenience to the Customer; subject to the reservations and principles set out in the relevant provisions of the Civil Code.
f) The Customer may, instead of the removal of the defect proposed by the Seller, request replacement of the Product with one free from defects, or instead of replacement of the Product, request removal of the defect, unless bringing the Product into conformity with the contract in the manner chosen by the Customer is impossible or would require excessive costs compared to the method proposed by the Seller. When assessing the excessiveness of costs, the value of the Product free from defects, the type and significance of the identified defect, and the inconvenience to which the Customer would be exposed by another method of satisfaction are taken into account.
g) It is recommended that the Customer include in the complaint description: (1) information and circumstances concerning the subject of the complaint, in particular the type and date of occurrence of the defect; (2) a request for the method of bringing the Product into conformity with the Sales Contract or a statement of price reduction or withdrawal from the Sales Contract; and (3) contact details of the complainant – this will facilitate and speed up the processing of the complaint by the Seller. The requirements stated in the previous sentence are only recommendations and do not affect the effectiveness of complaints submitted without the recommended description.
h) The Seller shall respond to the Customer’s complaint immediately, no later than within 14 days from the date of its receipt. If the Customer has requested replacement of the item or removal of the defect, or has submitted a statement requesting a price reduction, specifying the amount by which the price is to be reduced, and the Seller has not responded to this request within 14 days from the date of its receipt, it shall be deemed that the request has been acknowledged as justified.
i) The Seller is liable under the warranty if a physical defect is discovered before the expiry of two years from the date of delivery of the Product to the Customer. The claim for removal of the defect or replacement of the Product with one free from defects becomes time-barred after one year from the date of discovery of the defect; however, in the case of an Order placed by a Consumer – the limitation period may not end before the expiry of the period referred to in the first sentence.
